DOD 35% F&A Limitation is Eliminated

The Council on Government Relations (COGR), an association of research universities, announced on April 15th and then further clarified in its spring announcements , that the DOD (Department of Defense) F&A limitation on basic research funding was being eliminated for new proposals.

“As the FY 2011 final budget bill (Department of Defense and Full-Year Continuing Appropriations Act of 2011 – P.L. 112-10) did not include language that addressed the DoD limitation – by virtue of that language not being in the legislation, the DOD limitation effectively has been eliminated for the new awards issued by DOD.”

At this time, neither the DOD nor ONR (Office of Naval Research) has issued additional guidance, however, as there are issues that require clarification, namely, “the treatment of the limitation on multi-year awards funded with appropriations prior to the passage of P.L. 112-10 and post P.L. 112-10” the Offices of Sponsored Programs and Grants and Contracts Accounting along with COGR will continue to monitor the situation and will provide updated information as it becomes available.
