However, behind the joy and nostalgia of these seemingly timeless traditions lies the often-overlooked world of intellectual property (IP) law. While these laws ensure creators receive the recognition they deserve for their work, they also play a surprising role in shaping how we share and celebrate the staples of the holiday season.<\/p>\n<h3>Protecting holiday icons<\/h3>\n<p>Take Santa, for example. While the character of Santa Claus, with his red suit and snowy beard, is universally recognized and part of the <a href=\"https:\/\/www.britannica.com\/topic\/public-domain\" target=\"_blank\" rel=\"noopener\">public domain<\/a>\u2014meaning there\u2019s no overarching trademark tied to him\u2014not every depiction of Santa is free for use. Coca-Cola\u2019s version of Santa, for instance, is a specific and iconic portrayal so closely associated with the company that it is <a href=\"https:\/\/scholarblogs.emory.edu\/techtransfer\/2022\/04\/six-things-to-know-about-trademarks\/\" target=\"_blank\" rel=\"noopener\">trademarked<\/a> (trademark registration number <a href=\"https:\/\/trademark.justia.com\/781\/96\/coca-78196491.html\" target=\"_blank\" rel=\"noopener\">3121372<\/a>). <img loading=\"lazy\" decoding=\"async\" class=\" wp-image-4117 alignleft\" src=\"https:\/\/scholarblogs.emory.edu\/techtransfer\/files\/2024\/12\/phil-hearing-CvcZI4dMAGI-unsplash.jpg\" alt=\"A Santa ornament\" width=\"243\" height=\"365\" srcset=\"https:\/\/scholarblogs.emory.edu\/techtransfer\/files\/2024\/12\/phil-hearing-CvcZI4dMAGI-unsplash.jpg 800w, https:\/\/scholarblogs.emory.edu\/techtransfer\/files\/2024\/12\/phil-hearing-CvcZI4dMAGI-unsplash-768x1152.jpg 768w\" sizes=\"auto, (max-width: 243px) 100vw, 243px\" \/>This means Coca-Cola\u2019s Santa, first featured in their 1930s advertising campaign, is protected for use on items like snow globes, cookie jars, ornaments, playing cards, and more. Any depiction resembling this version cannot be used commercially without permission, ensuring Coca-Cola\u2019s Santa remains exclusively tied to the brand.<\/p>\n<p>Rudolph the Red-Nosed Reindeer offers another example of how IP law intersects with tradition. Created by Robert L. May for a Montgomery Ward Christmas promotion in 1939, Rudolph\u2019s story quickly gained fame and became synonymous with holiday cheer. A decade later, Johnny Marks\u2019s song cemented Rudolph\u2019s place in holiday history. Yet both the character and the song are <a href=\"https:\/\/scholarblogs.emory.edu\/techtransfer\/2024\/03\/breaking-down-intellectual-property-in-pop-culture\/\" target=\"_blank\" rel=\"noopener\">protected under copyright and trademark law<\/a>; the name &#8220;RUDOLPH THE RED-NOSED REINDEER&#8221; is registered under U.S. Trademark Registration Number <a href=\"https:\/\/trademarks.justia.com\/732\/68\/rudolph-the-red-nosed-73268848.html\" target=\"_blank\" rel=\"noopener\">1,309,723<\/a> and there is a design trademark for Rudolph&#8217;s red-tipped nose on a deer-like animal, registered under <a href=\"https:\/\/trademarks.justia.com\/737\/73\/n-73773767.html\" target=\"_blank\" rel=\"noopener\">1,974,435<\/a>. Any depiction of holiday reindeer must steer clear of these defining features to avoid legal infringement.<\/p>\n<p>Holiday music also operates under strict IP boundaries. It\u2019s no surprise that modern classics like <em>All I Want for Christmas Is You<\/em> are protected by copyright, but even some of the most universal tunes, like <em>Feliz Navidad<\/em> and <em>It\u2019s Beginning to Look a Lot Like Christmas,<\/em> require licensing agreements for public performances or adaptations. However, older songs like <em>Jingle Bells<\/em> or <em>Silent Night<\/em> are in the public domain and <a href=\"https:\/\/support.easysong.com\/hc\/en-us\/articles\/360047491414-Christmas-Songs-in-the-Public-Domain\" target=\"_blank\" rel=\"noopener\">can be used freely<\/a>. Public performances of holiday-themed works, even at small local theater productions or school concerts, often require permissions that come with fees, even for seemingly simple acts like singing a carol. And the holiday movies that air year after year are controlled by licensing agreements that dictate how, when, and where they\u2019re broadcast. This is why certain classics only have limited airings or are tied to exclusive streaming deals.<\/p>\n<p>But IP doesn\u2019t just preserve tradition\u2014it fuels innovation. In 2013, a patent was filed for LED light displays synchronized to music (<a href=\"https:\/\/patents.google.com\/patent\/US20060137510A1\/ru\" target=\"_blank\" rel=\"noopener\">US20060137510A1<\/a>), technology that has now become a staple of holiday celebrations.
